The Family and Medical Leave Act (FMLA) says:

Companies with 50 or more employees must give workers up to 12 weeks per yearof unpaid leave to care for a child, spouse or parent with a serious health condition.

Companies must allow employees to return to their old jobs, or equivalent jobs at the same pay, when returning to work.

During the leave, companies must provide the same health benefits as when employees are being paid.

However, law does not apply to all employees. You are entitled to FMLA leave only if you have worked for your employer for at least a year and have worked at last 1,250 hours (about 25hrs per week) during that time.
